Trading Terms & Conditions

Agreement for the use of The Day Spa website. By using http://www.thedayspasalon.co.uk/, you agree to be bound by these Terms and Conditions and any other guidelines or rules applicable to other services that may be posted from time to time. If you do not agree with any part of the following terms of conditions you must not use the site. If you are uncertain, you can always contact us (info@thedayspasalon.co.uk).

REFUND POLICY Under the Distance Selling Regulations you have a right to cancel your order for any payments made via this website, up to 7 working days after receiving it and receive a full refund. If you are unsatisfied with your order, please Contact Us, quoting your name and date ordered. If we can not resolve the problem to your satisfaction, we will ask you to return the products to our Correspondence Address and once received we will make a refund providing the items are unopened, unused and undamaged. Refunds are NOT given on any products that have been opened or/and used unless the item is faulty. Funds will be credited into the same account that was debited. If you wish to change an unopened item this will be done but will incur a 3 pound charge to cover administration and postage and packing plus any cost difference of the items. A cheque payable to The Day Spa should be sent with your returned item.

DELIVERY LEADTIMES Items purchased will be despatched as soon as possible. A leadtime of up to 10 business days should be allowed. For deliveries to Western Europe and Rest Of World Countries, a leadtime of up to 15 business days should be allowed.

ORDERS LOST IN THE POST Unfortunately this does happen and if an order is lost in the Postal system, The Day Spa will need to claim on the Post Office insurance. In completing our claim form, we will provide the name and contact details of the intended recipient. Before we send a replacement, we will require our lost post form to be completed, signed and returned to us confirming non-receipt. You can find the form on the Royal Mail.com web site for printing or we can email you if you prefer.

ORDERS FROM THE CHANNEL ISLANDS We are happy to accept orders from the Channel Islands but regret that we do not provide VAT refunds since the administrative cost which would be passed on to the client to action this would exceed the refunded amount.

ORDERS FROM THE REPUBLIC OF IRELAND Delivery is via Royal Mail's International Registered Post and a signature may be required upon delivery. The delivery cost is 6.50 VAT is charged on all deliveries.

ORDERS FROM OTHER WESTERN COUNTRIES AND FROM REST OF WORLD Delivery is via Royal Mail's International Registered Post and a signature may be required upon delivery. The delivery cost is 7.00 VAT is charged on all deliveries.

PRIVACY We will not share your personal information for marketing or any other purposes without your consent unless where required by law. If you have registered your interest with The Day Spa and thereby given your consent, you may be contacted with relevant information that you have expressed an interest in or that might be of interest to you. With The Day Spa YOU are always in control of your personal information, if at any time you wish us to stop contacting you then simply email us at info@thedayspasalon.co.uk We will always respect your privacy and any personal communication between you and ourselves. We will always comply with any data protection legislation currently in force. Cookies are small files of information that are stored on your computer. Web sites you visit ask your computer to store certain information and later retrieve it from your computer. We may use cookies to enhance your site visit. OBLIGATIONS Our Obligations The Day Spa will provide you with up to date information on the functionality of the site and advice and assistance on any upgrades or changes to its functionality, as it deems necessary; and use reasonable endeavours to comply with any statute, regulation or other ordinance as and when they come into force. Your Obligations You agree that you will only use the site in accordance with these Terms and Conditions and shall comply with all applicable laws and regulations. You represent, warrant and undertake that you will not do anything or cause or permit anything to be done that may infringe, damage or endanger any intellectual property rights of Serenity Beauty or do anything that is otherwise unlawful.

WARRANTY Exclusion of Warranty We try to make sure the information contained on this site is as accurate as possible. However we give no warranty of any kind regarding the site and/or any materials provided on the site. The Day Spa does not warrant the accuracy, completeness, currency, or reliability of any of the content or data found on this website expressly disclaims all warranties and conditions, including implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage in trade.

LIABILITY The Day Spa assumes no responsibility and shall not be liable for any damage to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the site. In no event shall The Day Spa be liable for any injury, loss, claim, damage, or any exemplary, punitive, direct, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with: any use of this site or content found therein, any failure or delay (including, but not limited to) the use of or inability to use any component of the site the performance or non-performance by The Day Spa the provision of or failure to provide services any information, software, products, services and related graphics obtained through the site. The Day Spa's liability shall not be limited in the case of death or personal injury directly caused by The Day Spa's negligent act or omission.
